§1 Scope of Application – Contract Status
(1) The following Terms and Conditions will apply to the purchase of the goods by a costumer.
A customer is an individual acting for purposes which are wholly or mainly outside his or her trade, business, craft or profession (§ 13 BGB).
All products are for personal use only and not for subsequent commercial sewing.

§2 Conclusion of contract
(1) The following rules about the conclusion of contract apply to any orders via the webshop https://stainedpatterns.com .

(3) The customer’s order constitutes a binding offer and will proceed via clicking the “Add to basket” button. The contract is concluded once the digital goods (download link) are delivered.
(4) The order process is as follows:
1) Select product(s)
2) Click the button „Add to basket“
3) Check your data in the basket
4) Agree to Terms and Conditions and Cancellation Policy.
5.) Agree to the loss of the right of revocation once the order is fullfilled (§ 18 Abs 1 Z 11 FAGG). Now what does this mean: If you buy a physical product in a shop, you can revoke the contract and send the product back. This process of “returning” a purchase, is not possible when it comes to digital goods. If you have any questions about this, please send me an e-mail).

§3 Prices, Delivery Costs, Payment methods
(1) All prices are final prices. VAT exempt due to the small business regulation (gem. § 6 Abs. 1 Z 27 UStG 1994).
There are no delivery costs, as all products are digital.

§4 Delivery
(1) Digital products will be made available via download.
(2) Products are delivered automatically once we received the payment.
§5 Retention of Ownership
We shall retain the ownership of the delivered good(s) until we received the payment.
§6 Revocation Policy
A customer is an individual acting for purposes which are wholly or mainly outside his or her trade, business, craft or profession (§ 13 BGB).
Withdrawal
You have the right to revoke this contract within a period of fourteen days without stating any reason. The period of revocation shall be fourteen days from the date of conclusion of the contract. In order to exercise your right of revocation, you must inform us of your claim by means of a clear and written statement. You can use the template below (see §7) to do so, but this is not a requirement.

Consequences of revocation
If you revoke the contract, we will pay you all the payments that we have received from you withing a period of fourteen days from the date on which your notice of revovation has been received by us.
IMPORTANT: Loss of the right of revocation (§ 18 Abs 1 Z 11 FAGG)
The right of revocation epires early in the event of contracts for the purchase of digital goods which are not stored on a physical carrier (for example: PDF sewing pattern), if you hve granted consent to performance of the contract commencing before the expiry of the cancellation period and you were aware of having waived your right of revocation by giving such consent.

§9 Contract language
Contract language is German.
§10 Choice of Law and Jurisdiction
The General Civil Code of Austria (Federal Law) is applicable. Place of jurisdiction is Graz, Austria.
§11 Alternative Dispute Resolution
The European Commission provides a platform for online dispute resolutions which can be accessed here: http://ec.europa.eu/consumers/odr/.
We are neither obliged nor willing to participate in the dispute settlement proceedings before a consumer dispute resolution body.
